7. Guarantee

Original so-called “branded” consumables are guaranteed directly by their manufacturer. Other consumables (so-called generic or remanufactured) not covered by the manufacturer's warranty are guaranteed by Comete Consumable for a period of 2 years from their delivery date. In the event of a defect, only products falling within the warranty coverage may be exchanged, subject to the agreement of customer service.

The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

To comply with the contract, the property must:

- Be suitable for the use usually expected of a similar good and, where applicable: correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model ,

- Present the qualities that a buyer can legitimately expect in view of the public declarations made by the seller, by the producer or by his representative

- Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

The action resulting from the lack of conformity is prescribed two years from the delivery of the goods.

Note : Ordinance 2005-136 2005-02-17 art. 5: The provisions of this ordinance apply to contracts concluded after its entry into force. With the exception of the legal withdrawal period, any return of a product requires contacting our Customer Service beforehand. Packages without an order number will be refused by our service, resulting in a return to sender. Return costs, with the exception of the return of defective consumables covered by their 2-year warranty or following a preparation error on our part, are the responsibility of the customer.
